Charges - Commonwealth matters
Section 20BQ of the Crimes Act 1914 (Cth) is similar to section 32 and is available for Commonwealth matters being dealt with to finality in the Local Court. It applies to people 'suffering from intellectual disability' or 'suffering from a mental illness within the meaning of the civil law of the State or Territory'.
The significant difference between section 20BQ and section 32 is that under section 20BQ(1)(c) if the charges are dismissed conditionally, the period of the final order can be up to three years as compared to the six-month final order period under section 32.
